Processing of (personal) data by the entity in charge of the online application process

Data protection information for applicants

These notes inform you about the processing of your personal data when you apply for a job at FELD M GmbH by letter, e-mail or via the online application tool (hereinafter: "application procedure").

1. Responsible for data protection

2. Your data when calling the online application tool

When you call up the online application tool, the following data (so-called log files) are recorded by the web server of the FELD M service provider for technical reasons and stored until they are automatically deleted: referrer, content accessed, date and time of the server request, data volume, access status, browser version and type, identification data of the browser and operating system used, and IP address.

The temporary storage of the IP address by the system is necessary to enable the website to be delivered to the user's computer. For this purpose, the user's IP address must remain stored for the duration of the session.

The storage in log files is done to ensure the functionality of the website. The data also serves to ensure the security of our information technology systems. An evaluation of the data for marketing purposes does not take place in this context.

This is also in our legitimate interest within the meaning of Art. 6 Abs. 1 lit. f DSGVO.

3. Your data when sending an application

3.1 Your application data

If you apply online for a position at FELD M, you can send your application documents to FELD M either by e-mail or via the online application tool.

In order to process your application, FELD M needs your contact data, your CV and relevant certificates. In addition, you can voluntarily provide FELD M with further information, for example in your cover letter or by providing additional documents.

All of these personal data will be referred to collectively as "application data" in the following.

Unless you apply directly via the online application tool, your application data will be entered manually by FELD M into the online application tool in order to ensure a uniformly standardized application process.

FELD M processes your application data exclusively for the purpose of carrying out the application process. This includes, in particular, the recording and checking of the application by FELD M, as well as contacting you for the purpose of inviting you for an interview, requesting further information about you, if necessary, or for the final acceptance or rejection with regard to the specific position for which you have applied.

Your application data will only be made available to those FELD M employees who are directly involved in the application process, including the decision on filling the position.

3.2 Legal basis

The legal basis for the data processing described above is Art. 6 Abs. 1 lit. b) DSGVO in conjunction with Art. 88 Abs. 1 DSGVO in conjunction with § 26 Abs. 1 S.1 BDSG (data processing for the purposes of the employment relationship, in particular for the decision on the establishment of an employment relationship).

4. Your data when sending your application after direct contact via XING or LinkedIn

4.1 Implementation

For all positions, we search the professional networks XING and LinkedIn for suitable candidates for FELD M. On XING, we use the XING Talent Manager service.

In our search, we use the profiles provided for this purpose and created by XING and LinkedIn users themselves to decide whether to contact a candidate. When we contact a candidate, we introduce ourselves and the position to be offered. If the candidate responds, the information from the profile is transferred to our online application tool and the application process begins.

4.2 Your application data

The data of the candidate processed in FELD M depends on the data that the user of the professional network discloses about himself. You can find out how to configure your privacy settings here for XING and here for LinkedIn. In principle, FELD M processes all information that you have disclosed in the respective network.

4.3 Legal basis

We process your data on the basis of our legitimate interest in being able to recruit suitable candidates as new colleagues. When weighing up the interests involved, we take into account in particular the legal concept of Art. 9 Abs. 2 lit. e DSGVO, which permits the processing of special categories of personal data if the data subject himself/herself obviously publicly discloses the data to third parties.

5. Experience Day

5.1 Implementation

For all positions, FELD M conducts a so-called Experience Day as part of the application process. This helps us to get to know each other better in order to be able to assess how well you fit the vacancy. During the Experience Day, we also use your application data in order to have a suitable basis for a decision.

Your application data will only be made available to those FELD M employees who are directly involved in the application process, including the decision on filling the position.

5.2 Legal basis

The legal basis for the data processing described above is Art. 6 Abs. 1 lit. b) DSGVO in conjunction with Art. 88 Abs. 1 DSGVO in conjunction with § 26 Abs. 1 BDSG (data processing for the purposes of the employment relationship, in particular for the decision on the establishment of an employment relationship).

6. Talent Pool

6.1 Your consent

If you have given your consent to be included in the Talent Pool, your applicant data will be stored by FELD M in a separate database, the so-called Talent Pool, beyond the end of the actual application process.

This gives FELD M the opportunity to contact you if you are still interested in employment and to continue the application process if you should be considered for another position.

The data will not be passed on to third parties.

For these purposes, FELD M processes the data mentioned in the above paragraphs which you have provided as part of the application process (e.g. in cover letters, CVs, certificates). FELD M points out that the applicant data may possibly contain special categories of personal data within the meaning of Art. 9 Abs. 1 DSGVO, such as information on a possible severe disability. In this case, your consent also refers to the storage of this data in the Talent Pool.

You can revoke your consent at any time informally without stating reasons with effect for the future, e.g. by telephone on +49 (0) 89 / 55 29 756 36, by e-mail to bewerbung@feld-m.de, in writing to FELD M GmbH, Sandstraße 33, 80335 Munich. Alternatively, you can also request a deletion using the link in the footer. You will find this link in the confirmation e-mail of receipt of your application.

If you withdraw your consent, the data will be deleted immediately, subject to the six-month retention period described below.

6.2 Legal basis

The legal basis for storage in the Talent Pool is Art. 6 Abs. 1 lit. a) DSGVO.

7. Storage duration

FELD M stores your personal data for the purpose of legal defence for up to six months after the application process has been completed. If you have given us the separate declaration of consent for inclusion in the Talent Pool, FELD M will store your personal data for 24 months. FELD M stores log files (see 2.) for a maximum of 30 days.

8. Data processing by service providers

Your applicant data will not be forwarded to third parties. Your data will only be disclosed to the service provider used by FELD M to provide the online application tool. This service provider is not allowed to process your data for its own purposes and acts for FELD M as a so-called contractor within the meaning of Art. 28 DSGVO. The corresponding contract for order processing has been concluded. Contractors are carefully selected and monitored by FELD M.

9. Place of data processing

The processing of personal data takes place exclusively in the European Union. A transfer to third countries in the sense of Art. 44ff. DSGVO does not take place.

10. Your rights

As a person affected by the data processing, you have various rights under the DSGVO, which FELD M would like to point out to you below:

10.1 Right to information

You can request information in accordance with Art. 15 DSGVO about your personal data processed by us. In your request for information you should specify your request in order to make it easier for us to compile the necessary data.

10.2 Right of correction

If the information concerning you is not (no longer) correct, you can request a correction in accordance with Art. 16 DSGVO. If your data is incomplete, you can request that it be completed.

10.3 Right to limit processing

Within the framework of the provisions of Art. 18 DSGVO, you have the right to request a restriction on the processing of data concerning you.

10.4 Right to deletion

You can request the deletion of your personal data under the conditions of Art. 17 DSGVO. Your claim for deletion depends, among other things, on whether the data concerning you is still needed by us to fulfil our legal obligations.

10.5 Right to data transferability

Under the conditions of Art. 20 DSGVO, you have the right to receive the data you have provided us with in a structured, common and machine-readable format and you have the right to transfer this data to another responsible person without obstruction by us. In addition, you have the right to request that the personal data be transferred directly by us to another responsible party, as far as this is technically possible.

10.6 Right of objection

Under Art. 21 DSGVO, you have the right to object at any time, for reasons arising from your particular situation, to the processing of data concerning you, provided that the processing is carried out on the basis of the legitimate interests of Field M.

10.7 Right to withdraw the declaration of consent under data protection law

If the processing of your personal data is based on your consent, you can withdraw your consent for processing at any time with effect for the future. The data concerned will then be blocked or deleted immediately, in accordance with legal storage periods.

By withdrawing your consent, the lawfulness of the processing of your personal data that has taken place on the basis of your consent until the time of withdrawal is not affected.

You can withdraw your consent in the same way as you give your consent. Alternatively, you can contact the addresses given in section 5.1.

10.8 Automated decision in individual cases including profiling

You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects in relation to you or significantly affects you in a similar way.

10.9 Right to complain to a supervisory authority

Without prejudice to any other administrative or judicial remedy, you have the right to complain to a supervisory authority, in particular in the Member State in which you are resident, your place of work or the place of the alleged infringement, if you consider that the processing of personal data concerning you is in breach of the DSGVO.

11. Necessity of data processing

The provision of your personal data is necessary for the implementation of the application procedure and thus for the possible establishment of an employment relationship with FELD M. Although you are not obliged to provide FELD M with your data, if you are not prepared to do so, the application procedure may not be carried out at all or not completely. In this case, no employment relationship can be established between you and FELD M.

Of course, this does not apply to the inclusion of your data in the Talent Pool, which is based solely on your voluntary consent (see Section 4).

FELD M does not carry out any statistical analysis of the data or any other observation of the behaviour of applicants (profiling); in particular, no automated decision making pursuant to Art. 22 Abs. 1 und 4 DSGVO takes place.

Processing of (personal) data by the operator of the recruitment website

General information

This recruitment website is operated by Personio SE & Co. KG, which offers a human resource and candidate management software solution (https://www.personio.com/legal-notice/). Data transmitted as part of your application will be transferred using TLS encryption and stored in a database. The sole controller of this data within the meaning of article 24 of the GDPR is the enterprise carrying out this online application process. Personio’s role is limited to operating the software and this recruitment website and, in this context, being a processor under article 28 of the GDPR. In this case, the processing by Personio is based on an agreement for the processing of orders between the controller and Personio. In addition, Personio SE & Co. KG processes further data, some of which may be personal data, to provide its services, in particular for operating this recruitment website. We will refer to this in more detail below.

Access logs (“server logs”)

Each access to this recruitment website automatically causes general protocol data, so-called server logs, to be collected. As a rule, this data is a pseudonym and thus does not allow for inferences about the identity of an individual. Without this data, it would, in some cases, be technically impossible to deliver or display the contents of the software. In addition, processing this data is absolutely necessary under security aspects, in particular for access, input, transfer, and storage control. Furthermore, this anonymous information can be used for statistical purposes and for optimizing services and technology. In addition, the log files can be checked and analyzed retrospectively when unlawful use of the software is suspected. The legal basis for this is §25 subsection 2 Sentence 2 TDDDG. Generally, data such as the domain name of the website, the web browser and web-browser version, the operating system, the IP address, as well as the timestamp of the access to the software is collected. The scope of this log process does not exceed the common log scope of any other site on the web. These access logs are stored for a period of up to 7 days. There is no right to object to this.

Error logs

So-called error logs are generated for the purpose of identifying and fixing bugs. This is absolutely necessary to ensure we can react as quickly as possible to possible problems with displaying and implementing content (legitimate interest). As a rule, this data is a pseudonym and thus does not allow for inferences about the identity of an individual. The legal basis for this is §25 subsection 2 Sentence 2 TDDDG. When an error message occurs, general data such as the domain name of the website, the web browser and web-browser version, the operating system, the IP address, as well as the timestamp upon occurrence of the respective error message and/or specification is collected. These error logs are stored for a period of up to 7 days. There is no right to object to this.

Use of cookies

So-called cookies are used on parts of this recruitment website. They are small text files which are stored on the device with which you access this recruitment website. As a general rule, cookies serve the purpose of ensuring secure access to a website (“absolutely necessary”), implementing certain functionalities such as standard-language settings (“functional”), improving the user experience or the performance of the website (“performance”), or placing targeted advertisements (“marketing”). On this recruitment website, we generally use only cookies that are absolutely necessary, functional or performance-related, in particular for implementing certain default settings such as language, for identifying the job advertising channel, or for analyzing the performance of a job advert via which a user accessed this recruitment website. Rights of data subjects

If the personal data is processed with your consent, you have the right to withdraw this consent under article 7 III of the GDPR. Concluding provisions

Personio reserves the right to adjust this data privacy statement at any point in time to ensure that it is in line with the current legal requirements at all times, or in order to accommodate changes in the services offered, for example when new services are introduced. In this case, the new data privacy statement applies to any later visit of this recruitment website or any later job application.
